Terms of Service
Last updated 11 October 2026
Please read these Terms before using myDiya AI. They apply to the myDiya web application, its command-line tools and its APIs. How we handle information is described in our Privacy Policy.
1. The agreement
These Terms of Service (“Terms”) govern access to and use of myDiya AI (the “Service”), provided by AscendQE (“AscendQE”, “we”, “us”). By signing in or using the Service you agree to these Terms on behalf of yourself and the organisation that gave you access (“Customer”).
If Customer has a signed agreement or order form with AscendQE, that document takes precedence over these Terms where they differ.
2. Accounts and access
- Access is given by Customer’s administrators, who decide each person’s roles and permissions.
- Keep your sign-in details secure and do not share your account. Tell us at support@ascendqe.com if you believe your account has been used without permission.
- Customer is responsible for the activity of the people it gives access to.
3. Acceptable use
You must not use the Service to:
- test, crawl or automate any website, application or system you are not authorised to test;
- break the law, infringe others’ rights, or process data you have no right to process;
- attempt to access another organisation’s data, get around security or permission controls, or probe the Service for vulnerabilities without our written permission;
- disrupt the Service or place an unreasonable load on it; or
- build a competing product by copying the Service.
We may suspend access that puts the Service, other customers or third parties at risk, and will tell Customer when we do unless the law prevents it.
4. Your content
Customer keeps all rights in the content it puts into the Service and in the outputs the agents produce for it, such as generated test code, reports and recordings. Customer gives AscendQE permission to host, process and transmit that content only as needed to provide and secure the Service, as described in the Privacy Policy.
Customer is responsible for having the rights and consents needed for the content it provides and for the systems and accounts it connects.
5. AI agents and their output
The Service uses AI models that can make mistakes. Review agent output — code, test results, diagnoses and suggested changes — before relying on it. Actions with an effect outside the Service, such as opening a pull request, run with the approval settings Customer chooses; Customer is responsible for the actions it approves or allows.
AI models are provided by the model provider Customer configures, under Customer’s own account with that provider and that provider’s terms.
6. Connected tools
When you connect another service — for example a source-code host or an issue tracker — the Service acts in it as you, using the access you grant. Your use of that service is governed by its own terms. AscendQE is not responsible for third-party services.
7. Our intellectual property
AscendQE and its licensors own the Service, including its software, design and documentation. These Terms give you a right to use the Service; they do not transfer any ownership. If you send us feedback, we may use it without obligation to you.
8. Fees
Fees, if any, are set out in Customer’s order form or agreement with AscendQE. Usage of third-party AI models is billed by those providers to Customer’s account with them.
9. Availability and changes
We work to keep the Service available and secure, and we improve it over time. We may change or remove features; if a change materially reduces the Service, we will give Customer reasonable notice.
10. Disclaimers
Except as stated in Customer’s agreement with AscendQE, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, AscendQE is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and AscendQE’s total liability arising from the Service is limited to the amounts Customer paid AscendQE for the Service in the twelve months before the claim, unless Customer’s agreement with AscendQE states otherwise.
12. Ending use of the Service
Customer may stop using the Service at any time, subject to its agreement with AscendQE. We may suspend or end access for a serious breach of these Terms. When access ends, Customer may ask us to export its content within a reasonable period, after which we delete it as described in the Privacy Policy.
13. Changes to these Terms
We may update these Terms. When we make a material change, we will tell workspace administrators before it takes effect. Continuing to use the Service after that means accepting the updated Terms.
